Terms of Service
These terms are the agreement between you and us for using NoteFish. Please read them. If anything is unclear, write to hello@notefish.ai.
1. Who we are
NoteFish is provided by Întreprinzător Individual „LEONARDO CALANCEA” (Î.I. „LEONARDO CALANCEA”), an individual entrepreneur registered in the Republic of Moldova under IDNO 1026023047638, with its registered office at bd. Ștefan cel Mare și Sfânt 141/2, ap. 45, MD-2004 Chișinău, Republic of Moldova ("NoteFish", "we", "us").
2. Who these terms apply to
These terms apply to anyone who creates a NoteFish account, installs a NoteFish app, or uses a NoteFish desk ("you").
If you use NoteFish for a business, you accept these terms for that business, and "you" means the business too. You confirm you are allowed to bind it.
You must be at least 18 years old.
NoteFish is offered in the European Union, the European Economic Area, the United Kingdom, Switzerland and the Republic of Moldova. It is not offered in the United States for now. Please do not use it for calls with people located there.
3. What NoteFish does
NoteFish helps you talk to people who speak another language. On a call, it:
- turns what you say into text and translates it;
- plays the translation to the other person in a synthetic copy of your own voice (a "voice clone");
- captions what they say in your language;
- keeps a written transcript and, on some plans, a summary.
It runs as a desktop app for Mac and Windows and as a desk in your browser. Callers can join from a call link in their browser, or NoteFish can work alongside a call you already have in another app.
The service is provided as it is at any time. We keep improving it, which means features can change. We will not remove a core feature you pay for during a paid period without giving you a pro-rata refund.
4. Your account
- Give accurate details and keep them up to date.
- Keep your password to yourself. You are responsible for what happens under your account.
- On a team desk, the admin decides who joins, what role each person has, and when someone is removed. The business the desk belongs to is responsible for its members' use of NoteFish.
5. Plans, payment and Paddle
Paddle sells NoteFish. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's own terms apply to the purchase (Paddle buyer terms).
Prices. Prices are shown on notefish.ai/#pricing. Paddle adds any sales tax or VAT due in your country at checkout.
Subscriptions renew. Pro, Max and Team renew automatically each month or year until you cancel. You can cancel at any time. The plan then stays active until the end of the period you paid for and does not renew.
Minutes. Plan minutes are for the period they belong to and do not carry over. Only the time NoteFish spends translating a call counts. Extra minutes are charged at the rate your plan shows, and only if you turn them on.
Free plan. The Free plan has the limits shown on the pricing page. We may change them with notice.
Price changes. If we change the price of your plan, we will tell you at least 30 days before it applies to you. You can cancel before then.
Refunds. Refunds are covered by our Refund Policy.
6. Your voice
A voice clone is a copy of a real person's voice. On NoteFish it can only be a copy of your own.
- Only your own voice, recorded live. A voice is made only from a recording made on NoteFish with the microphone, never from an uploaded file. The recording starts with you reading a consent sentence aloud, and NoteFish checks that the sentence is in the recording before it makes anything. You also confirm on screen that it is your own voice, and we keep a record of that confirmation with the voice.
- No voices of other people, and no famous voices. NoteFish offers no library of other people's voices, and voices cannot be shared, sent to someone else or imported.
- We use a voice only for what you do with NoteFish. That means speaking your translated replies, and letting you hear your voice. We do not sell voices, lend them out, or use them to train AI models. How the voice providers that make and speak the clone may use it is set out on the Sub-processors page.
- Nobody on a desk can answer in a colleague's voice. NoteFish enforces this.
- You can delete your voice at any time on the Voice screen. Deleting it removes it from NoteFish, and NoteFish deletes the copy each voice provider holds at the same time (see Sub-processors).
- Clones are optional for staff. An employer must not require an employee to clone their voice. Every person must be free to say no, or to delete their clone later, without any disadvantage.
7. Telling the people you call
The law requires people to be told when they hear an AI-generated voice or are being transcribed. In the EU, that is the AI Act (Article 50) and the GDPR.
On a call, you (or the business you work for) decide to use NoteFish. So you are responsible for telling the people you talk to. NoteFish helps in three ways:
- Call links. The caller page tells callers in writing, before they press Call and during the call.
- Other calls. For calls in other apps or on the phone, NoteFish speaks one line in the caller's language before your first reply: "This call is transcribed and translated by AI, in my own voice." This is on by default.
- Your own greeting. An admin can turn the spoken line off if your phone greeting already tells callers. You must then make sure it does.
You are also responsible for any other rule that applies to your calls: recording and transcription consent where the law requires it, your own privacy notice to callers, and your sector's rules.
8. What you must not do
Do not use NoteFish to:
- make a copy of anyone's voice but your own, play someone else's recording or voice into the microphone, try to get around the spoken consent check, or pretend to be someone you are not;
- mislead anyone about whether they are hearing an AI voice;
- commit fraud, scams or phishing, or harass, threaten or deceive anyone;
- make automated or mass calls, telemarketing calls, or calls to people who have not agreed to be called where that consent is required;
- break any law, or anyone's rights, including privacy, recording and consumer-protection laws;
- record, transcribe or translate anyone where you are not allowed to;
- get around plan limits, share accounts outside your team, or resell NoteFish without our written agreement;
- copy, reverse engineer or overload the service, or try to reach data that is not yours.
We may suspend an account that breaks these rules, as described in section 13.
9. Translations can be wrong
NoteFish uses AI. AI can mishear words and mistranslate them, and a translation can sound right and still be wrong.
- Check anything that matters before you act on it, such as names, numbers, addresses, amounts, dates, and medical, legal or safety information.
- NoteFish is not a certified interpreter.
- NoteFish is not certified for emergency services (112/911). Do not rely on it alone where a mistake could put someone's life, health or safety at risk.
10. Your content
What is yours. Your recordings, transcripts, summaries, notes and settings are yours. You give us permission to process them only to run NoteFish for you: to transcribe, translate, speak, store, show and delete them.
No AI training. We do not use your content to train AI models. How each of our providers may use data is set out on the Sub-processors page.
How long we keep it. Ended calls and their transcripts are deleted automatically after the period your admin chooses. The default is 90 days, and it can be 30 days to 2 years. You can delete calls sooner at any time. We do not store call audio.
Personal data you give us to process. Where your content includes other people's personal data, such as your callers', you are the controller and we process it for you. Our Data Processing Agreement applies and forms part of these terms.
11. Our part
NoteFish itself, including its software, design, name and logo, belongs to us. You may use it under these terms. This gives you no ownership of it.
If you send us ideas or feedback, we may use them without owing you anything.
12. Other services
NoteFish works with other companies' services, such as meeting apps, phone networks and AI providers. Their terms apply to your use of them. We are not responsible for them, and a change on their side can affect NoteFish.
13. Suspension and ending
You can stop at any time. Cancel your plan, delete your account in Settings, or ask us.
When we can suspend or end your account:
- Immediately: if you seriously or repeatedly break these terms, use NoteFish unlawfully, or put others at risk.
- Otherwise: we give reasonable notice where we can.
- If we stop NoteFish altogether: we give at least 30 days' notice and refund any unused prepaid period.
Your data after the account ends. It is deleted within 30 days, except where the law requires us to keep something, such as billing records. Paddle holds those. Export or save what you need before you close the account.
14. Warranties
We provide NoteFish with reasonable care and skill. Beyond that, and as far as the law allows, we make no promise that it will be uninterrupted, error-free, or fit for a particular purpose.
If you are a consumer, you keep all rights the law gives you, and nothing in these terms takes them away.
15. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
If you use NoteFish for a business:
- What we are not liable for: indirect or consequential loss, lost profits, revenue, business or data.
- Anything else: our total liability in any 12 months is limited to the amount you paid for NoteFish in those 12 months.
If you are a consumer: we are responsible for foreseeable loss caused by our breach of these terms or our lack of reasonable care. We are not responsible for loss that was not foreseeable.
16. If you use NoteFish for a business
You will cover us for claims by others that arise from:
- your use of a voice that is not your own;
- not telling the people you call where the law requires it;
- your content;
- your breach of the law in using NoteFish.
17. Changes to these terms
We may update these terms, for example when the law or NoteFish changes. For significant changes, we tell you by email or in the app at least 30 days in advance. If you do not agree, you can cancel before the change applies. The date at the top shows the latest version.
18. Law and disputes
These terms are governed by the law of the Republic of Moldova. Disputes go to the courts of Chișinău.
If you are a consumer living in the EU or elsewhere, you also keep the protection of the mandatory laws of the country where you live. You can bring a claim in your own courts.
Before going to court, please write to us. Most problems can be sorted out quickly.
19. Everything else
- If a part of these terms turns out to be invalid, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your account to someone else without our agreement. We may transfer these terms to a business that takes over NoteFish, and your rights stay the same.
- These terms, the Privacy Policy, the Refund Policy and, for business customers, the Data Processing Agreement are the whole agreement between us about NoteFish.
